Two liquor violations close Durango brewery

20-day down time, 10 days suspended sentence

A Durango brew pub Tuesday started a 20-day suspension of its liquor license for violations in 2012.

Durango Brewing Co. sold sealed or unsealed containers of alcoholic beverages outside the licensed premises at 3000 Main Ave. and sold to a minor, according to the state Department of Revenue’s liquor enforcement division. The former violation occurred July 27, 2012, the latter Aug. 14, 2012.

Durango Brewing’s license was suspended from Tuesday through May 12, although the suspension will be lifted from 9 a.m. to 6 p.m. May 5.

Ten days were held in abeyance pending one year of good behavior.

The pub has been closed since Tuesday, although that was not a mandatory closure. If open, it could sell food but not liquor.

Signing the stipulated agreement with the state’s liquor enforcement division was the most expedient solution, Mark Harvey, general manager of Durango Brewing, said Thursday.

“It was the path of least resistance,” Harvey said by telephone. “I guess you could call it the path of least hassle.”

In a stipulated agreement, the licensee gives up the right to a hearing, to an attorney, to subpoena witnesses and to appeal.

Harvey and Patrick Maroney, acting director of the liquor enforcement division, signed the agreement April 18.

It’s the second time in the last six months that a local establishment has closed because of a violation. The Irish Embassy Pub’s liquor license was revoked from Nov. 25 to Dec. 6 for serving liquor to a 20-year-old employee and refusing to let law enforcement inside early New Year’s Day 2013.
