A 6th Judicial District judge has dismissed a lawsuit filed by a parent against Durango School District 9-R for disciplining his son.

Judge Jeffrey Wilson on Wednesday dismissed the complaint of Robert Cikraji in its entirety.

Cikraji filed the lawsuit in March over an incident that occurred in September 2013. His son, Christoph, a 14-year-old freshman at Durango High School and a member of the school’s cross country team, ran a 10K charity race in Dayton, Ohio, sponsored by the U.S. Air Force.

When Christoph returned, he was suspended for one cross country meet because he had not obtained permission from his school principal to take part in a non-school meet.

Coincidentally, Christoph’s teammates competed in a meet the same day he ran in Dayton.

Among the allegations of Robert Cikraji’s lawsuit, were that his son ran a road race, not a cross country race, and the Colorado High School Activities Association rules – under which 9-R operates – refer to team competition, not individual competition.

As a result of district action, Cikraji alleged interference of parental rights, intentional infliction of emotional distress and defamation.

Wilson didn’t buy any of it.

In a statement, 9-R Superintendent Dan Snowberger said the result was expected.

“The courts have dismissed the Cikraji case, citing full agreement with the district’s handling of the situation under CHSAA guidelines,” he said. “We are saddened that this situation escalated to such levels, but we are quite satisfied with the outcome.

“Durango School District 9-R will always adhere to policies and guidelines provided by athletic associations such as the CHSAA,” he said. “We will continue to work with our students and our families to ensure they understand the policies and follow them as well.”

The district now will seek payment for legal fees, which have been covered under its liability policy with an insurance carrier.
