The two men suspected of shooting one man to death and wounding another early Monday at the Iron Horse Inn remained in La Plata County jail Tuesday on $1 million bail each.
The bail amount was requested by District Attorney Todd Risberg for Tyree Ogsbury-Jones, 22, and Aaron Christian Williams, 22, at an advisement hearing Tuesday before 6th Judicial District Judge Jeffrey Wilson.
Both defendants, shackled and wearing orange jumpsuits, appeared subdued Tuesday in court. Ogsbury-Jones was asked to speak up at one point because his answers to routine questions from the judge were inaudible.
Attorneys for the two defendants said the amount was excessive, particularly in light of their records. But Wilson upheld Risberg’s request, saying the bond assures appearance of the men to answer charges. They face potential life sentences if convicted, Wilson said.
John Moran and Justin Bogan from the state public defenders office represented Ogsbury-Jones. Chris Trimble, an attorney in private practice appointed as a public defender, represented Williams.
The defendants face potential charges of aggravated robbery, burglary, attempted murder and first-degree murder. They were ordered back to court at 10 a.m. March 30 for a formal filing of charges.
Meanwhile, the defendants were told not to contact Brian Keith Moore, 53, who was treated for three superficial wounds – to chin, hand and shoulder – at Mercy Regional Medical Center and released Monday.
They also were ordered not to contact the Iron Horse Inn.
Meanwhile, the other man who was shot at the Iron Horse and who died on the operating table Monday at Mercy Regional Medical Center was identified as Daniel M. Johnson, 50, of Durango. Police released his name Tuesday after the family had been notified, police Lt. Ray Shupe said.
Investigators have recovered a Remington .22-caliber rifle believed to be the murder weapon at a house at 1208 Avenida del Sol, Shupe said. The rifle belongs to Ogsbury-Jones.
The .22-caliber rifle was found in an apartment belonging to several young women who allowed Ogsbury-Jones to sleep on the couch after he was kicked out of the Iron Horse Inn room he had shared with Moore and Johnson.
Investigators believe that a property dispute among the three over marijuana plants led to the eviction of Ogsbury-Jones several days ago and the subsequent shooting Monday.
Detectives also found a blue bandana at the house that they believe Ogsbury-Jones used during the shooting. They also found a computer tablet believed to have been taken from the Iron Horse.
The women at the 1208 Avenida del Sol apartment cooperated with police, Shupe said. They didn’t know that Ogsbury-Jones had hidden the items there.
A crime-lab team from the Colorado Bureau of Investigation searched a 1994 beige Ford Crown Victoria that the suspects were driving when they were arrested.
