Shooting suspects recount fatal encounter to Durango police

Two young men suspected of killing Durangoan Daniel M. Johnson, 50, earlier this week at the Iron Horse Inn offered sharply different accounts of the incident to police.

According to an arrest affidavit released Wednesday, Tyree Ogsbury-Jones, 22, told Durango Police Department Detective Burke Baldwin he and “A-Dub” – a nickname for Aaron Williams, 22 – went to the Iron Horse Inn to confront Brian Keith Moore, 53, his former roommate, about stealing his marijuana plants.

On arriving at the Iron Horse, Ogsbury-Jones told police Williams “knocked on the door, and someone opened it.” Williams entered the room and “immediately got into a physical altercation,” and Williams yelled at Ogsbury-Jones, “shoot him, shoot him!” Ogsbury-Jones said.

Ogsbury-Jones “admitted that he shot Johnson once or twice, and then shot at Moore who was running toward the bathroom.” After they chased Moore into the bathroom, Ogsbury-Jones said he “shot into the bathroom door.”

A redacted affidavit made it impossible to know who answered the door. Johnson died from his injuries during surgery at Mercy Regional Medical Center; Moore survived.

Ogsbury-Jones said Williams stole a computer tablet on their way out.

In contrast, Williams told police that he thought they were going to the Iron Horse “to meet ‘females.’ Williams told police he had no idea what Ogsbury-Jones was planning to do.”

Williams “admitted he was wearing a ski mask and Ogsbury-Jones was carrying a gun.”

Williams told police he knocked on the door, and said “hello” to the man who answered the door, at which point, Ogsbury-Jones entered and shot his former roommates. Ogsbury-Jones chased Moore into the bathroom, while Williams “attempted to render aid” to Johnson in the living room.

Williams admitted taking the tablet.

Ogsbury-Jones and Williams are former football players at Fort Lewis College.
