When an in-person request was made for Quintanas contract, the clerk responded she was unsure if the contract was an open public record and needed time to find out.
She asked for the requesters name and contact information, neither of which pieces of information are required under Colorado law.
Later that afternoon, upon being contacted by phone, she said the contract was available, but she would need an e-mail or hand-delivered request before any copies could be made. She would not quote a price for the copy.
When the requester returned to see the contract, a copy was made at a cost of 10 cents per page with no demand for a written record request.
The contract, which has been in effect since February 2006, began paying Quintana at the rate of $65,741 per year, with increases projected each year after a positive review and as the town budget allowed. The contract had not been updated to reflect Quintanas current salary. Quintana also has the use of a car provided by the town for town business.
