The case against a Durango man charged with sexual assault on a child in August 2019 has been dismissed, court records show.
Richard Devenero, who was 27 at the time of the incident, was accused of inviting a 15-year-old girl into his home and touching her without consent.
The case has been sealed, and court documents are not available to the public. Devenero, however, provided court documentation to The Durango Herald that shows his case was dismissed March 5.
Why the case was dismissed remains unclear.
Devenero declined to comment for this story. His attorney, Heather Little, said she was unable to comment.
Sixth Judicial District Attorney Christian Champagne said that legally, all he is allowed to say is records for Devenero don’t exist in his office.
According to an arrest affidavit, Devenero saw the girl Aug. 12 on the Animas River Trail behind Durango High School and invited her over to wait for her friends. The girl knew Devenero as the stepfather of one of her friends.
