Farmington man suspected of 12th drunken driving charge

Lee was on probation for suspected 11th DWI
Bobby Harrison Lee, 39, was arrested Dec. 14 and charged with a suspected 12th DWI, according to court documents.

A Farmington man was arrested on a suspected 12th drunken driving charge after he crashed his car on County Road 3950.

Bobby Harrison Lee, 39, was on probation for another DWI conviction in February, and a review of court records showed he was charged with DWI twice in 2023 and twice in 2022. Prior to that he had DWI charges and convictions dating back to 2005.

In the new case, Lee is facing a second-degree felony 12th DWI, a fourth-degree felony battery upon a peace officer, a misdemeanor assault upon a peace officer, a misdemeanor resisting, evading or obstructing an officer and a misdemeanor driving on a suspended license.

The charges are in connection to a crash at 6:25 p.m. Dec. 14 in the 100 block of County Road 3950. When San Juan County Sheriff’s deputies arrived on scene, they reportedly found the white Buick SUV on its side and Lee in the driver’s seat on his phone.

When Lee got out of the vehicle, he reportedly had “bloodshot and watery” eyes. His speech was slurred, and he was “not maintaining his balance,” according to the statement of probable cause.

Deputies stated that they asked Lee how much he had to drink, and he reportedly became combative with them with a “clenched fist” and leaned toward them “as if he was going to strike me,” the deputy wrote in the statement.

Deputies managed to take him to the ground and handcuff him, at which time they stated Lee attempted to “headbutt” them, and then reportedly stated his back was broke, court records state.

An ambulance was called to the scene, but medics reportedly believed Lee to be “too combative” to transport to the hospital, so he was taken there in a patrol vehicle.

Once at the hospital, it is alleged Lee continued to fight and kicked a hospital staff member and “struck” a deputy in the “right forearm with his foot, while wearing cowboy boots,” court records state.

A blood sample was drawn at the hospital, Lee being taken to San Juan County Detention Center, where he reportedly “spit” at a deputy.

In the February case, Lee was arrested at 7:38 p.m. Feb. 25 outside of the Farmington Police Department, where he was arguing with his wife, Grace Harrison.

Farmington Police had video of Lee driving his car into the parking lot, and exiting the driver’s side door. He reportedly was drunk and too “argumentative” for a field sobriety test. He reportedly refused a breath test, according to the statement of probably cause.

Grace Harrison reportedly told police her husband was “intoxicated” and had been driving, court records state.

The arresting officer noted in the statement of probable cause that the Triple I “showed 11 previous DWI charges and one dismissed DWI charge.”

However, on May 8, Lee was allowed to plead no contest to a second DWI. He was sentenced to 364 days in the San Juan County Detention Center with 71 days of presentence confinement, followed by five years of unsupervised probation, according to court records.

Lee was released from jail on Aug. 8 and “has shown no indication that he intends to stop drinking and driving. This behavior continues to put the public in danger,” according to a motion for pretrial confinement filed in the 11th Judicial District Court by the San Juan County District Attorney’s Office.

The pretrial motion also states that there are DWI arrests in 2005, 2006, 2011, 2014, two arrests in 2023 and 2024.

Lee is being held in the jail and a detention hearing is set at 1:30 p.m. Dec. 19 in District Judge Stephen Wayne’s courtroom in Aztec.
